Operator and scope

This website is operated by MODA X INC, doing business as Moda X, at 1455 Lake Avenue, Rochester, NY 14615, United States. These Terms describe use of modaxonline.com, the Moda X mobile app, and purchases through our store. Our Shipping, Returns, Cancellations, and Privacy policies provide additional information. Mandatory legal rights take priority over conflicting wording.

Using the website

Provide accurate information and use the website lawfully. Do not submit fraudulent orders, access another person's account without permission, interfere with security, or misuse protected content. If you create an account, keep access credentials confidential and notify us of suspected unauthorized use.

Products, prices, and availability

Products are subject to availability. We aim for accurate descriptions, photographs, and prices, although errors can occur and screen settings can affect displayed colors. Prices are shown in the currency identified on the website and at checkout. Applicable taxes and shipping charges are disclosed before payment; international import charges may be collected separately as explained in our Shipping Policy.

If an error or stock issue affects an order, we will contact you. We will not charge a higher price without your agreement. If we cancel an order, we refund collected payments for the canceled merchandise and associated shipping charges. We may decline orders for legitimate reasons such as unavailability, suspected fraud, or shipping restrictions, subject to applicable law.

Shipping, cancellations, and returns

Our published policies explain timeframes, costs, and procedures. If shipment is delayed beyond the promised period, we provide the applicable delay notice, consent option, and cancellation/refund remedy. Our standard change-of-mind return remedy is exchange or store credit; this does not exclude refunds or other remedies required by law.

Promotions and rewards

Promotions are subject to their disclosed terms. Moda X Rewards benefits are subject to the published program rules and the reward conditions shown in Smile. See our Rewards page for current earning and redemption details. We will not retroactively withdraw a discount already accepted on an order solely because the promotion later changes.

Content and third-party services

Moda X content and third-party brand assets remain the property of their respective owners. Do not reproduce protected content beyond uses allowed by permission or law. Third-party links and payment services may have separate terms and privacy practices. These do not remove Moda X's responsibilities for your purchase.

Privacy and communications

Our Privacy Policy explains handling of personal information. We may send transactional messages needed to process and support your order. Marketing preferences are separate; you may unsubscribe from marketing emails without losing necessary order updates.

Customer rights and disputes

Please contact us if something goes wrong so we can try to resolve it. Nothing in these Terms excludes warranties, remedies, consumer protections, or liabilities that cannot lawfully be excluded. New York law applies, subject to mandatory protections and jurisdiction rights applicable where you live. These Terms do not impose mandatory arbitration or waive class-action rights.

Updates and contact
